About the Amendment

The amendment would protect our freedom in Virginia to make reproductive health care decisions without fear of government interference or criminal punishment. It amends the state constitution to ensure we can make our own decisions around reproductive health care, from contraception to childbirth.

What it does, why we need it

Right now, the Virginia Constitution does not recognize the right to reproductive health care, which means that politicians have the ability to restrict or ban certain reproductive health care. This amendment protects the freedom to make reproductive health care decisions and ensures the government cannot interfere.

Amendment Process

The amendment must pass both chambers of the General Assembly with a majority vote for the first time.

Completed: February 2025

The House of Delegates must retain a supportive majority after the November elections.

Completed: November 2025

The amendment passes both chambers of the General Assembly with majority support for a second time.

Completed: January 2026

The Governor signs legislation that puts the question on the ballot for voters.

Completed: February 2026

The amendment must pass with a majority of voters choosing “yes” in the General Election.

Timing: November 3, 2026

The text of the amendment is added to the Virginia Constitution, giving ALL Virginians the fundamental right to reproductive freedom!

Timing: January 1, 2027

Ballot Question

Should the Constitution of Virginia be amended to (i) protect the freedom to make personal decisions about prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care; (ii) protect doctors, nurses, and patients from being punished for these decisions; and (iii) allow for restrictions on access to abortion during the third trimester of pregnancy except when the patient’s health is at risk or the pregnancy cannot survive?

Governor Spanberger Sends Reproductive Freedom Amendment to the People

Today, Governor Abigail Spanberger signed legislation that allows the historic Constitutional Amendment for Reproductive Freedom to appear on the ballot this November. With this signature, the legislative phase of the state constitutional amendment process has officially concluded. It is now up to the people to protect their freedom to make their own reproductive health care decisions.
