Virginians for Reproductive Freedom exists to protect, expand, and defend reproductive rights through advocacy, education, and organizing. We work to ensure every Virginian can access the care they need without political interference.

About the Amendment

The amendment would protect the right to reproductive freedom in Virginia. It is designed to safeguard personal decision-making and ensure these rights cannot be easily taken away.

What it does, why we need it

This amendment would establish clear protections for reproductive freedom under Virginia law. At a time when abortion rights remain under attack, these protections are more important than ever.

Amendment Process

The amendment must pass both chambers of the General Assembly with a majority vote.

Completed: February 2025

The House of Delegates must retain a supportive majority after the November elections.

Completed: November 2025

The General Assembly passes legislation, signed by the Governor, that puts the question on the ballot for voters.

Completed: February 2026

The General Assembly passes legislation, signed by the Governor, that puts the question on the ballot for voters.

Completed: Legislative Session 2026

The amendment must pass with a majority of voters choosing “yes” in the general election.

Timing: November 2026 Election

The text of the amendment is added to the Virginia Constitution, giving ALL Virginians the fundamental right to reproductive freedom!

Ballot Question

Should the Constitution of Virginia be amended to (i) protect the freedom to make personal decisions about prenatal care, childbirth, postpartum care, birth control, abortion, miscarriage management, and fertility care; (ii) protect doctors, nurses, and patients from being punished for these decisions; and (iii) allow for restrictions on access to abortion during the third trimester of pregnancy except when the patient’s health is at risk or the pregnancy cannot survive?

Governor Spanberger Sends Reproductive Freedom Amendment to the People

Today, Governor Abigail Spanberger signed legislation that allows the historic Constitutional Amendment for Reproductive Freedom to appear on the ballot this November. With this signature, the legislative phase of the state constitutional amendment process has officially concluded. It is now up to the people to protect their freedom to make their own reproductive health care decisions.

Richmond, Va – Earlier today, Senator Jennifer Boysko and House Majority Leader Charniele Herring joined the Virginians for Reproductive Freedom Coalition at a press conference to celebrate the passage of the reproductive freedom constitutional amendment resolution. 

Victory: Reproductive Freedom Amendment is Officially on the Ballot

Richmond, Va. – Virginia is one step closer to protecting our freedom to make reproductive health care decisions, from contraception to childbirth, without fear of government interference or criminal punishment. Today, legislators accomplished a key milestone of the multi-year process to amend the Virginia Constitution to protect families’ reproductive health care needs. The reproductive freedom resolution passed through the Senate by a floor vote of 21-18. The resolution passed through the House by a floor vote of 64-34 on the first day of session.
